Seller identity
LinguaLive is operated by Rafael Dejesus Atencia Mercado, a natural person with residence in Bogotá, Colombia (the "Seller"). By using LinguaLive you enter into a binding agreement with the Seller. If you are using LinguaLive on behalf of an organisation you confirm that you have authority to bind that organisation to these Terms.
The service
LinguaLive is an AI-powered real-time interpretation platform that provides translated chat, voice, video, dictation and in-person conversation features through a credit-based system and optional subscription plans.
Acceptance
By creating an account or using LinguaLive you accept these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service.
Eligibility
You must be at least 16 years old (or the minimum digital-consent age in your country, whichever is higher) to use LinguaLive. The service is not intended for children below that age.
Your account
You are responsible for the accuracy of the information you provide and for keeping your credentials confidential. You must notify us immediately of any unauthorised access to your account. You are responsible for all activity that happens under your account.
Credits and subscriptions
LinguaLive uses credits to meter usage of chat, dictation, voice, video, in-person and image features. Free users receive a one-time welcome bonus. Paid plans grant a fixed amount of credits each billing period; unused monthly credits do not roll over. Credit packs are one-time purchases that add credits to your wallet and do not expire. Specific credit costs per action are shown in the application and may be adjusted with notice.
Payments
All payments are processed by Paddle.com Market Limited and its affiliates acting as Merchant of Record. Paddle is responsible for taking payment, issuing invoices and collecting applicable taxes. The commercial terms that apply to your purchase, including billing frequency, renewal, cancellation and payment-method handling, are set out in Paddle's Buyer Terms at https://www.paddle.com/legal/checkout-buyer-terms.
Prohibited conduct
You must not use LinguaLive to: (a) break any law or infringe third-party rights; (b) generate or distribute illegal, harmful, hateful, defamatory, sexually-exploitative or harassing content; (c) impersonate others, attempt fraud, send spam or commit payment-method abuse; (d) reverse engineer, scrape, probe, attack or interfere with the service; (e) resell, sublicense or share account access; (f) circumvent credit metering, rate limits or technical restrictions.
Intellectual property
LinguaLive, including its software, branding, designs and documentation, is owned by the Seller and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the service under your active plan.
Your content
You retain ownership of the content you submit (messages, audio, images, translations). You grant LinguaLive a limited licence to host, process and transmit that content strictly to provide the service to you and the people you communicate with.
AI features and accuracy
Translations, transcriptions and voice outputs are generated by AI models and may contain errors, omissions or unintended interpretations. LinguaLive must not be relied upon as a substitute for professional legal, medical, financial or safety-critical interpretation. You are responsible for verifying outputs before acting on them and for not submitting content that you do not have the rights to process.
Service availability
We work hard to keep LinguaLive available and accurate, but we do not guarantee that the service will be uninterrupted, error-free or fit for any particular purpose. We may add, modify or discontinue features at any time.
Suspension and termination
We may suspend or terminate your access in the event of material breach of these Terms, non-payment, security or fraud risk, abusive use, or repeated violations of our policies. You may close your account at any time from your settings; closure does not entitle you to a refund except as described in our Refund Policy.
Disclaimers
To the maximum extent permitted by law, LinguaLive is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the maximum extent permitted by law, the Seller's aggregate liability arising out of or relating to your use of LinguaLive is limited to the amounts you paid for the service in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special or punitive damages, including loss of profits, data or goodwill. Nothing in these Terms limits liability that cannot be excluded by law, such as for fraud or personal injury.
Changes
We may update these Terms from time to time. When changes are material we will notify you in the application or by email and update the "Last updated" date above. Continued use after changes take effect constitutes acceptance.
Governing law
These Terms are governed by the laws of the Seller's country of residence (Colombia), without prejudice to any mandatory consumer-protection rights you may have under your local law. Disputes will be resolved by the competent courts of that jurisdiction, unless a different forum is required by mandatory law.
